Update:
The #JusticeforRizwana case has now taken another major development, a local court in Islamabad has overturned the accused, Civil Judge Asim Hafeez’s wife Somia’s interim bail.
The news comes as a relief to the parents of the 14 year old Rizwana who have been fighting tooth and nail for her survival.
Earlier this week, a local court that handles both district and sessions cases had provided temporary release to the defendant Somia until today, August 7th. This was granted upon submission of a surety bond amounting to Rs100,000.
Additional Sessions Judge Farrukh Fareed, nullified Somia’s temporary release and issued an order for her immediate arrest. This case had garnered significant public attention, and public was demanding justice on behalf of the young victim.
Judge Fareed instructed the prosecution to remain uninfluenced by any external pressures as they pursued the truth. He explicitly directed them to thoroughly investigate the case based on its merits.
The accused, Somia has been under investigation by the Joint Investigation Team (JIT) with whom she has appealed to be innocent, denying any involvement with Rizwana.
However, in the application for her temporary release, the defendant refuted the accusations made against her in the initial complaint, describing them as unfounded, fabricated, and an outcome of excessive exaggeration. Somia insisted that Rizwana was not harmed and was returned safely to her parents.
The pain she endured is beyond comprehension, all because of accusations of stealing gold jewelry. The spouse of Civil Judge Asim Hafeez, who holds a position at the Federal Judicial Academy, is accused of subjecting Rizwana to this heinous treatment. After the distressing ordeal, she was eventually sent back to her parents, who rushed her to Sargodha for medical care before relocating her to Lahore.
With over 15 torture marks borne by Rizwana over a short period of 6 months, her health has been compromised where chances of her survival are slim. From extreme physical violence to attempted murder, the minor has been subjected to all forms of torture including being poisoned.
Major Development in #JusticeforRizwana Case
Recent development in the Rizwana case has come to light where the accused has been charged with 8 more sections added to the FIR by the Islamabad police, strengthening their case further against the wife of a civil judge. Eight additional sections of the Pakistan Penal Code (PPC) to the First Information Report (FIR) were added concerning the torture of a 14-year-old maid, Rizwana who is currently on a ventilator fighting for her life.
Section 324 (attempted murder) was included in the FIR based on the victim’s father’s statement, which was documented in the police case diary on July 26.
Furthermore, the police incorporated seven more sections into the FIR in response to the Medico-Legal Certificate (MLC) issued by the DHQ Teaching Hospital Sargodha. These added sections are:
- 337-A (i) (hurt by any weapon on head or face without exposing bone of the victim)
- 337-A (ii) (hurt by any weapon on head or face where bone is exposed but no fracture is caused)
- 337-A (iii) (grievous hurt by any weapon on head or face resulting in bone fracture without dislocation)
- 337-F (i) (injury in which the skin is ruptured and bleeding occurs)
- 337-F (v) (injury leading to fracture of bone)
- 337-L (ii) (punishment for other hurt)
- 334 (Itlaf-Udw) (intentional destruction of a limb or organ).
Sources in the Islamabad police said the sections were added to the case keeping in view the evidence received through the MLC by the police. Addition of sections 3 (b) (compelled labour) of Prevention of Trafficking in Person Act 2018 to the case was also under consideration, they added.
