Time and time again we’ve heard the issues faced by women when it comes to their rights, however very few know that the nikkah nama is there to give them just that. Pakistani drama ‘Kuch Ankahi’ has highlighted just that.
In it’s most recent episode, the drama has created buzz showing that no matter what, clauses that give a woman her rights should not be cut out, no matter who the groom is or how moderate the family may be.
The scene in particular shows Samiya (played by Mira Sethi) and Saif (played by Ali Safina) about to tie the knot. Samiya’s aunt, played by Vaneeza Ahmed, interrupts the maulvi sahab, asking him to not cut out any clauses.
On the other hand, the maulvi replied that the clauses in the marriage agreement hold little importance and the groom’s side usually cuts them out. The groom’s mother backs the cleric stating that they are respectable people and they would never take advantage of the bride even if the clauses are not there.
However, the phuppo shuts everyone down by staying adamant building up to the fact that alimony, child custody and divorce clauses are for the protection of women and no one has the right to remove them, no one at all.

Nikah Clauses for Women’s Rights

This clause ensures that women are not treated as commodities and that their financial independence is protected. The Mahr serves as a safety net for women in case of divorce, providing them with some financial security.
Another important clause is the Talaq clause, which outlines the procedure for divorce. In Islam, divorce is permitted but considered the last resort. The Talaq clause ensures that women have a say in the divorce process and that it is not a one-sided decision made by the husband. The Nikah contract can specify the number of times a husband can divorce his wife, or even require him to seek permission from a religious authority before initiating the divorce process.
The Nikah contract can also include clauses related to the wife’s maintenance, which ensures that the husband is responsible for providing for his wife’s needs during the marriage. The clauses can specify the type of maintenance the wife is entitled to, such as food, clothing, and shelter. The maintenance clause also ensures that the wife’s financial needs are taken care of if the husband becomes unable to provide for her.
In addition to the clauses mentioned above, the Nikah contract can also include clauses related to the wife’s rights in case of the husband’s death, such as inheritance rights. These clauses ensure that women are not left vulnerable after their husband’s death and are provided with financial security.
